Maryland has a new divorce law that will go into effect on October 1, 2015. Under the new law a married couple that has no children, who enter into a Marital Settlement Agreement, that resolves all issues of property and support, will be able to file for divorce without the currently required 12 months of separation. This will make uncontested divorces much easier to obtain in those situations where no children are involved.

The Court of Appeals published 2 decisions this week that may greatly affect my clients. In one case, the court declared unconstitutional the damages limitation provision of the Lead Paint statute passed in the 1990s. This means that landlords who comply with the lead abatement statute can no longer expect the limitation of damages that was the quid pro quo for complying. The second decision declared unconstitutional the portion of the Ground Rent Registration statute that terminated ground rents for properties that were not registered by the statute's October 2010 deadline. Therefore any certificates of extinguishment issued by the Department of Assessment and Taxation for failure to register ground rents are now null and void.
