People ask whether mediation is better than going to Court, and the answer is usually yes. One of the reasons for that is exemplified by an experience last week. We had a matter listed in Court before the Corporations List Judge. He was the only Judge available that day, due to staff and judges at the Court taking the school holiday break, and leaving the roster depleted. There were over 14 Motions in the Judge’s list and 18 matters for directions. The Court was literally bursting at the seams with Barristers and Solicitors seeking to direct their clients. Each of the legal practitioners was trying to obtain some advantage or benefit for their clients, and as a result it took the Judge an hour and a half to simply read through the list and plan his day, whilst deferring or adjourning matters to other days. This meant that many of the matters were simply not reached and, if the practitioners had prepared for their matter to be heard, their client would have incurred cost which may not be able to be recovered quickly because their matter was not reached. It is a fact of life that the government, who provide the judicial system, simply do not allocate sufficient resources at times for everyone’s case to be heard in a timely fashion by a suitable judicial officer. This results in delays to the matter and to additional costs being incurred. With a mediation, you will generally agree on a day for the mediation, and the matter will proceed on that day. The costs of a mediation are less than the costs of a hearing usually. If you negotiate an outcome, it is usually an outcome that has been agreed upon between the parties so that you know it should be given effect to. Mediation - a quicker and less expensive option.
Too often, people believe that conflict revolves around money, or emotion. The reality is that the biggest factor in conflict is time. People resent the past, fear the future, and remain stuck in the present,(if not the past). Most conflict intrinsically revolves around the only resource that we are limited in - time. All else can be changed, time is the only immutable, and inexorable reality. That's why our legal system uses time to resolve conflict.
