Specific Advocacy/Legal Priorities & Actions 1. "Housing as Healthcare" under Medicaid A. We have contacted state officials including but not limited to Suzanne Brennan, CO Medicaid Director with the CO Dept. of Health Care Policy & Financing) and Sue Birch, Ex. Dir. of HCPF, and Jennifer Weaver, Asst. Attorney General in the State Services Section of the CO Attorney General's Office who provides legal advice and counsel to HCPF. B. We have notified the state that it is Orchid's official position that failure to provide housing as a benefit under Medicaid to people with mental illness who are homeless amounts to violations of Equal Protection & Due Process Clauses of the U.S. Constitution and also amounts to gross and tragic discrimination against people with mental illness under the Americans with Disabilities Act. Also see USA Today article 6/26/14 which calls out "systemic discrimination" against people ;with mental illness under Medicaid and Medicare. http://www.usatoday.com/longform/news/nation/2014/06/25/stigma-of-mental-illness/9875351/ We are refining our legal arguments, consulting disability rights attorneys both here in Colorado and nationally, including the Bazelon Center for Mental Health Law ( www.bazelon.org ). We would like to work the State, AND the status quo is completely unacceptable from a legal, ethical, and moral standpoint -- and we will keep all legal remedies open.

Well, Orchid's individual advocacy or representation is generally limited to very selective requests for reasonable accommodations so that the person may live in the community and not on the street or in an institution. Much of what we do is NOT individual advocacy or representation, but rather "systemic advocacy," advocating for changes in Colorado policy. We deal with executive departments such as the Colorado Department of Health Care Policy & Financing which administers the Colorado Medicaid program. Orchid does believe that Colorado is ripe for an Olmstead lawsuit under the Americans with Disabilities Act (ADA) for failure to provide sufficient community services of the type needed by people with mental illness who are currently institutionalized, including in jails and prisons, or who are homeless and at great risk of institutionalization. If you can provide information that would help make such a case, you may submit it on this intake questionnaire. BOTTOM LINE: For many folks, this will be of little help. If there is information you need, we may consider putting it on the Orchid website. We are not set up to do large scale information & referral (I&R). For the past 14 years, the HRAC has been CO's primary provider of public health information, programming, and advocacy. The Harm Reduction Action Center is the only Colorado public health agency specifically focusing on injection drug users and their sexual partners that would not otherwise have access to appropriate health education, healthcare services, and emotional support designed specifically for the needs and culture of the IDU community. Formerly known as the “Little Red House” in the West side of Denver, the Harm Reduction Action Center serves more than 1,700 people affected by injection drug-use every year. HRAC (formally known as the Harm Reduction Project/Drop-In Center) is a recognized expert in providing HIV & Hepatitis C prevention programming, using harm-reduction principles to reduce the negative consequences of drug use impacting individuals, families and the larger community. Harm reduction enables us to meet drug users "where they're at," addressing the conditions of use along with the use itself. The Harm Reduction Action Center develops personal relationships with clients, guided by compassion, mutual respect, and evidence-based solutions, empowering clients to reduce the harmful effects of marginalized lifestyles.
